National News : सुप्रीम कोर्ट आज बुधवार को मुख्य चुनाव आयुक्त (CEC) और चुनाव आयुक्तों (ECs) की नियुक्ति से जुड़े 2023 के कानून को चुनौती देने वाली याचिकाओं को बड़ी संविधान पीठ के पास भेजा जाने या नहीं भेजे जाने के मामले में सुनवाई करने पर सहमत हो गया.
बता दें कि याचिका में इस मामले में हाल ही में आये विभाजित फैसले को वापस लेने की मांग की गयी थी. दरअसल 23 सितंबर को जस्टिस दीपांकर दत्ता और जस्टिस सतीश चंद्र शर्मा की पीठ ने इस मामले में अलग-अलग राय दी थी.
पीठ की राय बंट गयी थी कि क्या 2023 के उस कानून की वैधता को चुनौती देने वाली याचिकाओं के समूह को बड़ी संविधान पीठ के पास भेजा जाना चाहिए? जिसके तहत(CEC) और ECs को चुनने वाले पैनल से भारत के CJI को बाहर रखा गया है.
STORY | SC to examine plea for recall of split verdict on law governing appointment of CEC, ECs The Supreme Court on Wednesday agreed to examine a plea seeking recall of its recent split verdict on whether challenges to the 2023 law governing the appointment of the Chief Election Commissioner and Election Commissioners should be referred to a larger Constitution bench. On September 23, a bench of Justices Dipankar Datta and Satish Chandra Sharma gave split opinions on whether a batch of pleas challenging the validity of a 2023 law that excludes the Chief Justice of India from the panel for selecting the Chief Election Commissioner (CEC) and Election Commissioners (ECs) should be referred to a larger Constitution bench. It had said due to a difference of opinion, the matter be placed before CJI Surya Kant on the administrative side for constitution of a bench of appropriate strength for an effective and authoritative adjudication. On Wednesday, a bench comprising the Chief Justice of India and Justices Joymalya Bagchi and V Mohana was told about the recall application by senior advocate Gopal Sankaranarayanan. “We will examine and take a call,” the CJI said. पीठ ने कहा था कि राय में अंतर होने के कारण मामले में प्रभावी और आधिकारिक फैसले के लिए उचित संख्या वाली पीठ के गठन के मा्मले को CJI के समक्ष रखा जाये.
बता दें कि आज बुधवार को CJI, जस्टिस जॉयमाल्य बागची और जस्टिस वी मोहना की पीठ को वरिष्ठ वकील गोपाल शंकरनारायणन ने फ़ैसले को वापस लेने की याचिका के बारे में जानकारी दी. इस पर CJI ने कहा, हम इस पर विचार करेंगे. फिर फैसला लेंगे.
